I am a Realtor who sold a house to a client that wanted to remodel their new buy. I recommended they check out a design company who stocks cabinets, flooring, etc... They ended up using the design company. The design company found out that I referred them and they wanted to give me a gift for referring my client. Is it legal for me to accept a gift because they are not an appraiser, mortgage or title company? If it is illegal, how can I suggest the design company reward a realtor for their future referrals?

Welcome to the site! As to legality of the referral fee or even the propriety of it, you may want to check with your broker to see what the existing policy is. Who knows, but maybe there isn't one. Maybe a call to the Real Estate Commission? The quality of advice can vary from state to state and respondent to respondent.

Assuming everything was legal and proper, I would be careful of accepting it for 2 reasons: 1) I wouldn't want my client to think I had steered them to this designer, and 2) if anything goes wrong with the client/designer business relationship and the client finds out I got paid...well you already know how that will go.

But, I might ask the designer to offer the referral as a discount to my client and make sure the client knows why they are getting the discount.

Thank you. I spoke with the legal hotline and they stated that it was stepping the line of being illegal and legal. Summed up they advised not to accept a referral fee. I merely want to let this company know that this can get a Realtor in trouble so they don't get a bad rep. Thank you!
