I have another point regarding the exclusive use of mailbox by carrier only. Vandalism of mailboxes is bad, but imagine what it would be if it were not a federal crime.

To recap, I do know that every pressure washer, every babysitter, every yard mower, every newly opened $1.00 store, etc., would hire kids to distribute these flyers (or do it themselves) in our mailboxes to avoid paying postage. People would love an excuse to hire mailbox stuffers instead of paying postage. They are thinking--Why not pay a teenager $6.00 an hour to put 60 flyers in the mailboxes rather than spend...what's the fyler postage these days? Anyway, it would be cheaper and our mail would not be safe on our own property. Not to mention, no privacy because the people in our own neighborhoods would read our mail if they were handing out flyers. My biggest fear--while they were in there, they just might grab my check for my services. With access to the mailbox by just anyone, how can a neighbor say, "I saw him with his hand in your mailbox"? Now, people may be temped but most will not touch the mailbox. There is a reason for these laws, folks.

Most use email, fax, UPS, and other services for their communication needs these days, when possible. But the USPS still protects our mail while it is on our property, till we can get home and get it safely into our homes. This is very important for those who still get those pesky credit card offers, bank statements, pay checks, insurance settlements, and other very confidential information through the postal service. I shudder to think what would happen if anyone were allowed to open someone's mailbox. One Realtor handling out flyers is no big deal...but the postal service is not thinking of one Realtor, they are thinking about the identity theft expert who would take advantage by painting "yard service" on his van and driving around raiding mailboxes under the pretense of handing out flyers. Just my opinion.

Yes, don't put them any inside, outside, hanging from, taped to, or anything else involving the actual mailbox.

'Your' mailbox when installed in front of your house is designated as an official repository for U.S. Mail and your use must comply with U.S. Statutes and U.S. Post Office regulations.

"3.1 Basic Information for Customer Mail Receptacles

3.1.1 Authorized Depository

Except as excluded by 3.1.2, every letterbox or other receptacle intended or used for the receipt or delivery of mail on any city delivery route, rural delivery route, highway contract route, or other mail route is designated an authorized depository for mail within the meaning of 18 USC 1702, 1705, 1708, and 1725.

3.1.3 Use for Mail

Except under 3.2.11, Newspaper Receptacle, the receptacles described in 3.1.1 may be used only for matter bearing postage. Other than as permitted by 3.2.10, Delivery of Unstamped Newspapers, or 3.2.11, no part of a mail receptacle may be used to deliver any matter not bearing postage, including items or matter placed upon, supported by, attached to, hung from, or inserted into a mail receptacle. Any mailable matter not bearing postage and found as described above is subject to the same postage as would be paid if it were carried by mail."

Thanks, Jim, for doing the leg work. We all need to be clear on this, because it is very tempting, especially when first starting out. Postage makes mailouts too expensive for most Realtors. On the other hand, none of us want the "Feds" after us ( laugh ), so it's best to know the rules for sure.

The US Govt can't stop illegals from swamping your country but the USPS can not only scare the hell out of you so you won't put a flyer in a mailbox but it can have you arrested. I think you should put the USPS in charge of your borders and that would solve your illegals problem.
You REALLY give a govt. service that kind of power? Scarey.

Perry - I think Darlene B made it pretty clear as to why the law exists and why it's a good one. I highly doubt anyone will get thrown into a jailcell for putting flyer in a mailbox - but it's a good deterrent.

You jumped into the thread very quickly to criticize the USPS and now you are doing the same to the border patrol situation.

Maybe you didn't mean it to come off as such, but it seems there is some US bashing going on here.

There are stiff fines for misusing a mailbox. It also looks lazy, cheap, and unprofessional. If an agent is too lazy to walk up to my door, too cheap to buy a stamp, and lacks the ethics to follow federal law... there is no way I would hire this "professional" to list my house.

Also: Skip the food. You want to impress upon the visitors to the house that you are a local real estate expert, not a caterer. Preview every house in the area and know them cold. Make the attendees believe that they would be better off with you as their agent.
