I'm interested in what is in some of your licensed assistant contracts. How do you structure commission? What other details have you included? Competition clause?

I don't know if what I have to offer will be helpful, as I have never engaged a paid Assistant nor been involved as one.

However; I have known quite a few, and among those, most have been temporary situations where the Assistant had personal issues (Divorce, Illness, or Death) that took priority over the time demands of an un-predictable Sales routine (which is hardly routine) and the un-reliable income associated with it.

For that very reason, Commissions haven't been an issue as the Assistants have usually been paid a small salary or just an hourly wage while they got their lives back in order.

And the imposition of a Non-Compete Clause wouldn't have been practical as this is often a temporary matter and the Assistant has the intent to re-enter the Sales Force in the same territory once they get back on their feet. These have been situations where "Trust" between the parties already existed; it wouldn't work as well with someone off the street.

In this area, I can't think of a single instance where a person has prepared to work as a commissioned sales person only to then work permanently as a Licensed Assistant to another producer. Here, it seems to be only the creation of a position among Friends and comes into existence as an accommodation to the Licensee needing a source of income closely related to this industry.

I don't know how helpful that may be in Ohio,
