last week my dad informed me he entered into a contract without an agent to sell a property. i know you don't 100% need one but he is older and needs assistance. we had problems with the buyer - we suspect fraud. he cancelled the sale.

not sure if the contract was ever enforceable. she is no longer a real estate agent. she was arrested for lockbox abuse/theft & was to have her licenses revoked. she signed her husbands name instead of hers to the contract. she gave my dad a card that represents her as a agent. he thought she was. he NEVER signed the contract. he initialed 3 places on his contract. not sure if he signed theirs.

we went to the title company to find out what they had filed and turns out they had never filed it for processing. they had over 2 weeks to do so & the settlement was supposed to be for next week.

i read that the contract was really a offer since he never signed and she isn't a agent is this true?

Could you help us to help you by clarifying some of the pronouns with either names or titles?

This means your father cancelled the sale, right? How did he do that?

So, either the buyer is a female, who was actually a crooked agent...or a female crooked agent showed up with a buyer?

And it sounds like the buyer never moved the contract along at the title company, no?

And, it sounds like the title company didn't have a copy of the contract signed by all parties, right?

The buyer's status as an agent isn't really relevant. It could still be a binding contract whether she disclosed her status or not.

If your father signed the buyer's copy, there may still be a binding contract. Just because you, your father and the title company don't have a copy doesn't mean that there isn't a fully signed copy floating around.
