Hello,
I live in the state of MI, and recently at the urging of a friend have decided to pursue a real estate license. A few years ago I pled guilty to retail fraud 3rd degree ( a misdemeanor). I will spare the details, but subsequently the court dismissed my conviction, so I am not convicted, but I have pled guilty. Will I be able to get a license to sell real estate or will this incident hinder me?

Well, it won't help . . . . but only the Michigan Secretary of State and the Michigan Real Estate Commission can answer that question for sure.

I see that they provide you with a phone number to ask specific questions like you have now.

We've had many prospective Agents on this Forum who've had far less than perfect backgrounds . . . . and I believe most found their respective States to be cooperative in helping them to at least get considered for a License. To read these, do a search using the feature in the right hand column =====>>>

I think you'll find that most had issues which were more serious than your conviction; but I don't recall anyone coming here to discuss this issue within Michigan.

What constitutes "retail fraud"? Switching prices or returning items that were not purchased ?

I went through a self checkout lane at a grocery store and there were a couple small items I set in the basket portion of my cart when I first entered the store. I set my purse down later on in the basket and completely forgot about the items when I was scanning and checking out. I know that my carelessness was inexcusable, but it was unintentional. So, I don't know if that makes a difference or not. It was dismissed, so there is no conviction, but the guilty plea is there.

I think that is so minor you won't have a problem. In most applications, they allow you to explain what happened.

I would go ahead and try, you will never know for sure unless you do. This is a business of action - this will be your first act.
