Hello,

I want to pay a telemarketer to call through the classifieds and offer my flat rate listing service.

I am an OHIO broker. The gentleman I have in mind is not licensed. Can anyone give some clarity on exactly what a non licensed invidual can do or say?

Sounds like unlicensed folks cannot do much of anything in Ohio.

Question 2: Can an unlicensed person solicit business for the brokerage by providing information on the brokerage and brokerage services to potential clients and customers?

Answer: No, this activity requires a real estate license.

Question 4: Unlicensed personal assistants: What can they do?

Answer: Personal assistants who are not licensed may perform duties that would be considered secretarial or administrative in nature. According to the Division of Real Estate these could include:

Sitting silently in open houses as a security measure
Calling other brokerage firms to set showing appointments for the agent
Calling owners of properties listed with the agent's own brokerage, to schedule showings, closings and inspections
Acting as a courier for contracts and other documents
Question 5: Unlicensed personal assistants: What can't they do?

Answer: According to the Division of Real Estate, unlicensed personal assistants are prohibited from doing the following:

Providing potential clients with information on the services offered by the brokerage firm
Calling "for sale by owners" and owners of expired listings to determine their housing needs or interest in relisting
Explaining terms of home warranty programs, which may be part of a purchase offer
Responding to questions posed concerning contracts or other documents
Giving out pre-printed property information over the phone, including asking price, address and number of bedrooms
Passing out information sheets, verbally providing property information and responding to questions at open houses
Calling property owners to gather information on their home or the type of home they're looking for, providing information on listed properties and requesting names of other potential sellers or buyers.

Maybe that was their intent and precisely what they had in mind when they made Real Estate a highly regulated profession requiring a License ?

Andy,

You would be much better off having an agent join your firm and work out an arrangement where they call and they get a small cut from the ones that use your listing service. This way you only pay if it brings in business and they are NOT an employee you have to pay benefits and taxes on. There are agents willing to do this but you have to find them. Maybe put a small ad out and interview a few for the position and pick one.

You need to make sure you are also in compliance with the DNC list and make sure you have a script of what you want the person to say on the phone so yo ucan track and tweak the results.

You can also send out recorded phone blasts or e-mails but that get's expensive.

i personally dont like what you are trying to do at all, nor do i like to see agents taking flat fee listings, but here is the answer to your question. but if you are going to do it, make sure you do it the right way.

i would do this>>>>>>>>it would be easier to do a mailing campaign with an 800 number and extension attached...anyonem that makes inquiry can be solicited for 90 days unless they ask for you to take them off of your list.



here is anwer to what you were asking


recorded phone blast are illegal per the fcc if you do not have a prior business relationship (ie...they have not made an inquiry to you in the last 90 days)...per the rule if they have made inquiry you then have a 90 day window to send them blast voicemails or recorded messages.

per the fcc you can have a survey that you conduct...the survey could be done by an unliscensed individual, but htere can be no solicitation at all....you would then use the questions in teh survery to find warm, hot leads and stop by in person or mail something to them.....if/wehn they make contact with you based on your personal meeting and giving you permission to call(stopping by) or by calling you to make inquiry you then have 90 days that you are allowed to contact them because you the inquiry made.
