I bought my first home in October 2003. Clueless to the process, I relied on my agent to guide me. The seller is a Real Estate agent who purchased the house in April 2003 for $175,000.00. He made some upgrades and sold it to me for $248,000.00. I had a home insepection and there were not many problems found. The inspector informed me at the time of inspection that he could not go into the attic because of the lack of room nor in the crawl space for the same reason. Then there was a room in the back of my house which only had access by going outside first. The room was built completely under code and without a permit. The inspector made no mention of this room nor of the broken windows it had. I have a feeling that the inspectors know the seller personally and adjusted the inspection to favor the seller. I later discovered rotten floor beams and under code eletrical wire which would have been easily discovered if they would have crawled under the house.

Call the home inspector. Depending on liability in your state, he might be willing to work with you to address your concerns. Here in California, direct liability for the home inspector lasts for four years, with an additional 18 months for discovery liability. So we really do work hard to prevent complaints in the first place, but we also work just as hard to resolve complaints.

If the inspector noted in his report the areas that could not be inspected and more importantly "why" then he has done his job. Rotted floor joists and broken windows should have been noted in the report and you may have some recourse there but as far as codes and permits, that is beyond the scope of a home inspection unless it is a new construction home.

Codes and permits is beyond the scope of my home inspection in all circumstances, even new construction.
