Exactly BR! Most state legislatures have mandated that sellers provide all documents related to the homeowner's association (we now call them Common Interest Communities) for the buyer to review before making the purchase. So you often need a formal request to send over to the HOA, plus you need a disclosure form to show you have disclosed to the buyer that there is an HOA, plus you need an approval form from the buyer showing that he did indeed receive the documents. Of course, now this means HOAs have decided that they can charge a great deal of money to reprint these documents, such as minutes of the last meetings, operating budget, CC&R's, etc.
Depending on the laws of the state, those forms are required rather than just handy. --A

Shop around for good title companies.
While you will use this form on occasion, if your working with a saavy title company, they will do this for you. I have had some title companies that even keep the latest HOA docs for some communities on-hand in electronic format.
Let me make a suggestion. If you are active in your area, get a copy of the HOAs for yourself. Then scan them in as a PDF so for furture clients, you can give them via email. This does NOT relieve you of the need to get the actual documents from the HOA, but it gives the buyer some advance time to review them and makes you look like you are really on top of things.
For areas where I focus my farming, I keep a few CDs with this document on them so I can hand them to buyers. My info is, of course, all over the CD and made part of the footer on every page. So even if the file gets handed/copied to others, my branding is carried with it. As part of that footer, I put a disclaimer about the buyer still needing to obtain current HOA documents.

Guess what. $50 is NOT what we are charged here in Nevada. We're not talking about simply taking the CC&R handbook and copying it, which is something kinko's coulddo, either. There is your bogus $250 HOA TRANSFER fee, so that the HOA can recognize the new owner. Then there are the other fees involved in providing budgets, minutes, etc. --A

About $50 is what associations charge for a current copy of the docs here. Some associations now provide them electronically which some of my clients like and others hate. The transfer fee is a totally different thing, but we can talk about that as well. And if you think you can do it better/cheaper you ought to start up a HOA management company. I bet it'll be more work than you think. $250 for the transfer fee is not out of line if you ask me because they have to do a fair amount of work when people buy/sell. And if you don't like it you don't have to buy a property with a mandatory HOA.

Somehow the HOAs managed to figure out how to delete one owner's name and add the next owner's name before our legislature said that sellers legally had to provide documents to the new owner. Then they suddenly had a slew of fees, and consumers were obligated to pay them. I've been on HOA boards before, I know what they pay the management companies and what the management companies do. The extra fees they hit homeowners with are out of line. --A

Just to try to settle this argument...
Here in Nevada the HOA charges about $200 for the HOA docs! We can get the CC&R's from the title company but it won't come with everything needed. The HOA doc package comes with up to date information including minutes, operating budget, financial statements, etc. So even burning them on a cd would do us no good because we need the latest copies of everything when we open a transaction. Some of the HOA's put their info on a cd but they constantly update them all the time. In my opinion, $200 just for the docs is quite expensive. That is not including the $250 transfer fee that is charged just to delete the seller's name in the computer and add the buyer's name!

I also gave more specific numbers on how much charges are. We both know how much work it probably takes to transfer a name. It's pretty messed up that you stated that I should take more time to learn before sharing my wisdom! Are you saying that I am making incorrect statements? Time to learn? You have no idea how much I might know! And because I might know something, I shouldn't share my opinion? Isn't that what this board is used for? But that's the thing about this industry. Both agents are in Las Vegas yet they basically cut each other's throat. The market may be getting bad there but thats still no reason to act uncivil on a board and if s/he acts nasty on this board I can ONLY imagine how nasty s/he is offline. I don't think I was cutting anyone's throat. I think my opinion was bashed for no reason. You should see how nasty some agents get here in Las Vegas!
