We are in the process of purchasing a multi purpose property and the sale contract was signed by both us and the seller. We are paying for the property in full ( cash ) and took out a loan on our own home to pay towards this purchase. Our loan dragged for awhile and the seller is irritated to date. The closing date on the contract has expired about a month ago but no time of essence was submitted by the seller as they have no lawyer. Now, the seller is in california and supposedly does not want to go through the sale as he has better offers for the property. We have accumulated the sum of $ to pay for the porperty but the seller is sort of not responding. Can the seller back out of the sale? after the closing date has expired? Should the seller back out, can I sue him for all the expenses I've incurred for this property e.g. titles insurance, appraisal, lawyers fees, interests, points from loans? Please help........thanks

If the date on the contract has expired, the contract is void.
