I work for an agency that is strictly a transaction broker.

Is there a seller listing agreement that would only allow me to sell the home? I have a very nice FSBO and we talk every week or so. He seems to think that the buyer's agent does all the work. He's willing to pay a 3% plus a bonus to the procuring agent.

I'd like to help him out, but honestly, I don't know if I can. The only marketing he has done is put a FSBO sign on the mailbox. That's it. It's a great property from the outside and a fabulous price. With the right exposure, it would be sold in a day.

Is there anything I can do?

Well you could bring him a buyer. That is what he is asking you to bring the buyer. Tell him you would like to show him your marketing plan. There is no charge or obligation to see your plan. Explain how the Realtors are obligated to sell listed homes first becuase when you hire one Realtor you higher them all. Keep giving him information like a lead based pain form. You could give him a disclosure and disclaimer form too for free. If he asks questions tell him you cannot advise him becuase that would imply you where his agent and you respest the fact he is selling on his own. (no problem) The more information you give the better. Be a consultant and do not tell him he is doing anything wrong ever. He has to figure out selling his house is work on his own. You can explain how you would do it. Show value by explaining every step.

Maybe what are looking for is an open listing agreement? It is non-exclusive; then you could sell the home, and so could any body else... a little tricky if you advertise and an agent calls for their buyer. IAW Article 3 of the Code of Ethics you have to "cooperate with other brokers", not compensation - but the information on the property.


TerryinVA is best - show him your value - and just take an exclusive listing.
