Is there a police report? You need to press charges if possible and ensure that the police report is accurate and the people who were hurt/assaulted also file a report.

Yes there is a police report and my clients are going first thing Monday morning and pressing charges. I was not assaulted. So I see no need in filing charges on my behalf. I still just feel so sick about all this.. I feel especially bad for my clients... I had NO IDEA anything like this would happen!!!

this could have happened in Kentucky too. People here are crazy. It is common for neighbors to come out when I am showing a house and tell my clients all the bad things they might want to know about the property. But nobody has been assaulted yet, give it time. don't ya just love real estate.

ROFL! Remember the Century 21 gold jackets? Maybe instead we should all start wearing black and white stripe shirts, a yellow hankie in the back pocket and a whistle just in case!! Picture it - agent blows whistle, Sellers offsides, Sellers receive $500 lower asking price penalty or whistle blows, buyers delay of game, $500 higher asking price penalty. Hmmmmm maybe I've come up with an idea. lol

Never in Tuscaloosa. Trying to refrain from saying anything about that Only in Alabama crack. Next time if your phone has photos take a picture or if you have your digital camera and it has a movie mode records events such. Or call a voice mail and record the events. Your clients need to consult with your REO company as I am assuming this was your listing? If they join forces on the lawsuit it will give them more bite.

My clients have no bad feelings toward me. They said it wasn't my fault. No it wasn't my listing. We have the police reports, pictures of their wounds and the dispatcher I was on the phone with recorded the whole incident as I was on speaker phone with her. She stated that my client's attorney would probally ask for it at trial.. The listing agent is going to send a copy of the police reports, photos, and our statements to the REO Company and see what they are going to do about this. I found out today for sure that the man that attacked my clients was the man who lost the home to begin with.. So that is why he is like that.

Were you threatened? If so, you do have an assault case. Battery is making contact; assault is threatening or acting in a threatening manner.

Hey cussed me and called me the "b" word alot... Like I have stated before.. I am afraid that he is going to try and file a complaint with the Commission or file a lawsiut against me or my company for bringing my clients out there to look at a foreclosed property!! i am still sick over all of this...

It doesn't sound like this person is real smart so filing a complaint with the commission I wouldn't worry about..lol Wow, I am so sorry this happened!They will be in alot more trouble than you will be. You did nothing wrong and this totally was not your fault! Hang in there...you will get thru it all and I am sure it will turn out just fine!!

Update... My clients issued the warrant for the arrest of the man and his wife today. The listing agent is going to send a copy of the police reports and letters from other agents that have had problems with this man and she is going to see if the mortgage companies attorneys will handle it from here.
