Ok everyone... Its like this.. I went to show a foreclosure to day and when we got to the property the neighbor next to the house came out cussing me and my clients and gripping that the driveway we were on belonged to him. This was the only way to get to the home!!! He got in to a word fight with my client and then he slapped my client and they got into a fist fight!!! I dialed 911!!! Then the mans wife came out and started hitting my client while her husband held him and so my clients wife got into the fight and the mans wife hit my female client with a cordless phone in the head... They would not let us get to our vehicles and kept cussing us!!! I am just soooo... There are no words to describe!!! I have NEVER had this happen to me before!! My worry is that the man and his wife (NOT MY Clients) are going to try and sue me and my company when I wasn't even in the fight!! Any suggestions on what I should do from here??? I have already spoken with my broker and he told me to just take care of my clients... And my clients are going to press assault charges against the man and his wife.... Ughhhh...

Is there a police report? You need to press charges if possible and ensure that the police report is accurate and the people who were hurt/assaulted also file a report.

Yes there is a police report and my clients are going first thing Monday morning and pressing charges. I was not assaulted. So I see no need in filing charges on my behalf. I still just feel so sick about all this.. I feel especially bad for my clients... I had NO IDEA anything like this would happen!!!

I hate to say it but picturing that is kind of funny,only in alabama.

If that's the only road to get to the property then that IS NOT just his driveway and there is a recorded easement for the people that owned the back house to get in and out.

The people that assaulted your clients are really stupid and are in for a world of hurt when they go to court.On an easement you have to allow ingress and egress to the property.

In all seriousness i am sorry that happened to you and your clients.I knock on pre-foreclosure homes all the time just did 10 today and have never ran into anything like that,must have been lucky so far.

Hey maybe after your clients sue those homeowners they will get both properties,a 2 for 1 deal!

this could have happened in Kentucky too. People here are crazy. It is common for neighbors to come out when I am showing a house and tell my clients all the bad things they might want to know about the property. But nobody has been assaulted yet, give it time.

Picture it - agent blows whistle, Sellers offsides, Sellers receive $500 lower asking price penalty or whistle blows, buyers delay of game, $500 higher asking price penalty. Hmmmmm maybe I've come up with an idea. lol

North Alabama, I sorry that happen to you. But with all that going on, how was it possible that you managed to stay out of the fight??? How has your client attitude been towards you since the incident?

Never in Tuscaloosa. Trying to refrain from saying anything about that Only in Alabama crack. Next time if your phone has photos take a picture or if you have your digital camera and it has a movie mode records events such. Or call a voice mail and record the events. Your clients need to consult with your REO company as I am assuming this was your listing? If they join forces on the lawsuit it will give them more bite.

My clients have no bad feelings toward me. They said it wasn't my fault. No it wasn't my listing. We have the police reports, pictures of their wounds and the dispatcher I was on the phone with recorded the whole incident as I was on speaker phone with her. She stated that my client's attorney would probally ask for it at trial.. The listing agent is going to send a copy of the police reports, photos, and our statements to the REO Company and see what they are going to do about this. I found out today for sure that the man that attacked my clients was the man who lost the home to begin with.. So that is why he is like that.

Were you threatened? If so, you do have an assault case. Battery is making contact; assault is threatening or acting in a threatening manner.

I am afraid that he is going to try and file a complaint with the Commission or file a lawsiut against me or my company for bringing my clients out there to look at a foreclosed property!! i am still sick over all of this...

File your own complaint with the police. Get your story on record first.

It doesn't sound like this person is real smart so filing a complaint with the commission I wouldn't worry about..lol
Wow, I am so sorry this happened!They will be in alot more trouble than you will be. You did nothing wrong and this totally was not your fault! Hang in there...you will get thru it all and I am sure it will turn out just fine!!

Update... My clients issued the warrant for the arrest of the man and his wife today. The listing agent is going to send a copy of the police reports and letters from other agents that have had problems with this man and she is going to see if the mortgage companies attorneys will handle it from here.
