Good Evening All,

So I had an out-of-state buyer who came down to look at homes here in Colorado back in May 2017. He found a home he liked, we went under contract, and the home eventually closed in early July. Well, he just moved down last week, and he was not happy with the work that was done as per the inspection resolution. He said "nothing was repaired". Which is not true, because I saw with my own eyes that work was done, and I provided him with receipts the seller provided for the work done, and the handyman's information so he can call and get a walkthrough on all the items that were fixed, which were cosmetic. He keeps speaking of a repair that was not listed on the resolution, which he signed, and has stated he plans on taking me to small claims court. Should I be worried? If he does file a suit, what would that process be like for me? Any information would be helpful. Thanks in advance.

If he's that unhappy, he'll probably have to sue the Seller with whom he had a Contract and completed the transaction, and then negotiated that Inspection Resolution.

Right now, he's just angry and his hostility is being misdirected because you're the only one he knows and with whom he can vent.

If he had an Attorney representing him for the transaction, that person can counsel him on whether he has a basis for a suit and advise him on how best to proceed . . . . like "who" he should pursue. If he didn't have an Attorney, then he should seek that guidance now. Is he familiar with the Legal System in the US, or is he a foreigner of some kind ?

And it's not you that he needs to sue . . . . you're just a Facilitator. You and your Broker aren't even Parties to the Contract that he had with the Seller (or the HandyMan).

Thanks for the reply. He doesn't know much about the legal system, hopefully if he does choose to file a suit, the attorney will be able to tell him he doesn't have much of a case. The contract was executed as it stated it should have been, I think the issue is that he didn't like to review the documents, and now he is unhappy. Thanks again. Your input was much appreciated.
