I am a Realtor. During the last Florida hurricane my wooden fence at my own home partially blew down. I called a guy from an ad in the Pennysaver, he came gave me a price, did the job, was on time, cleaned up - all in all a very satisfactory job. As he was leaving he noticed my Realtor badge, gave me some of his cards, and asked me to refer clients to him that need repairs before listing their houses. Perfectly normal so far. Before I refer anyone for anything I do a quick Google check. It turns out this guy at the age of 40 had non forced sex with an underage girl (17), is a registered sex offender, and served a year in jail. This is probably not a guy I would refer but if I did is this something I would have to disclose especially now that I am aware of it?

I am afraid you would find it best to disclose.

I once had a house for sale in a very rural area, and within two weeks of putting up a sign, the local busy-body called anonymously to make sure I knew that there was a registered sex offender within 1000 feet of my Listing.

She let me know that if I failed to let everyone who I showed it to know about the neighbor, then she'd take it upon herself to make sure they knew.

I let the Owner know about this threat, and she immediately guessed who the Caller was, and said that the Offender was also the same guy who had been mowing her lawn for the past 7 years. She told me to not make it the 1st thing I mentioned; but to mention it before anyone really warmed up to the property and made an offer. She said she'd introduce any Buyer to the neighborhood offender . . . . "he had already paid his dues to society".

The old biddy down the street was very disappointed.

Maybe you should clear the matter with the handyman, so that he can accept your offer with the disclosure, or refuse it . . . . his choice ?

You have to be aware of your state laws. In MN we can't disclose anything about a sex offender living in a neighborhood. We can only point people to where they can find the information on their own.
