You can...just don't get caught...it violates most Board's policies in that you are not supposed to use previous MLS information to solicit. Also, goes against federal Privacy and possibly Do Not Call legislation
Penalties are in the thousands and can result in termination from the Board, not to mention the hassle of potentially having to deal with the Feds- our company got nailed with a $65k fine last year for violating DNCL rules
Yet there is no shortage of realtors willing to risk it due to the large potential reward and shortage of saleable listings
