For those of you that use professional photographers.
  • What are your expectations for being able to use those photos?
  • If you were told that you could use them on the internet, but had to pay extra to use them in newspapers or magazines, how would you respond?
  • Do you know the terms of service for your photographer?

When i hire someone to do something for me then i expect to own their work when they are done.

If you are going to take pictures of the house at no charge and then let me use all, some or none of the photos for a licensing fee per use then those other charges would be resonable.

But when i pay somone to do a job for me then i expect their work to belong to me just like evey other service i pay for.

I'm in the same Camp as BigToe; but I think you should go ahead and experiment.

Some people have so many Customers that they can afford to throw some of them away while doing their market research . . . . but I don't know of many !

Just to keep this discussion going, how would you feel if a developer were to hire you to sell a single home. Now, when you toured that home with your clients, they were exposed to advertising of all the other homes and subdivision the developer had to office. They were even required to sign-in with contact information and redirected to those other homes. But here's the catch, you will only get a commission on the one home, none of the others.

After all, they did hire you and thus should own your work when you are done.

You want to compare a real life situation, the photos, with a hypothetical situation, the developer.

Developers keep agents on staff to sell their homes. If the developer offers a commission to outside agents if they bring a buyer the outside agent runs the risk of having the onsite agents stealing the buyer. It happens all the time.

We routinely work our butts off and end up watching someone else get the paycheck n a variety of ways, so you are not going to find empathy from us about getting a licensing fee for a picture you already got paid to take.

You either take the pictures for free and license their use or you get paid to take pictures. You had better have the licensing in writing if you want to
enforce it in court.
