Hello, I had a quick question. I am VERY new to the real estate game and am confused.

Am I allowed to give a gift to a client after they put me down as the referral? I've heard a lot about agents giving 'Closing Gifts', but then I read somewhere else that you can spend a year in jail for something like that.

You can't go through life being afraid of your own shadow !

Most Real Estate Rules and Regulations are really quite practical, and not all that bizarre . . . . or causing you to deviate all that much from normal human courtesy or making gestures of thanks.

If prohibiting token gifts of appreciation were the case here in Vermont, I would be living in the Cross Bar Hotel for the rest of my life for giving subscriptions to the local Newspapers. Who's going to prosecute me for that ?

I doubt that Texas is much different. You probably heard about illegal Commission "kickbacks" that should be disclosed under RESPA. Check with your own Broker and consider it as Continuing Education.

In Florida, closing gifts are legal and quite normal. My firm has a unwritten $35 rule but it generally ignored and not ever enforced. A Realtor can pretty much do whatever they want with their money BUT it should not be given or promised as part of the deal or an inducement to make the deal. For example let's say the buyer and seller are $1,000 away on the purchase price and neither will budge and the deal is going sideways because of it. A Realtor could contribute a portion of the commission to the deal BUT cannot go to his buyer and tell them he will be giving them a $1,000 closing gift. Thats probably a non starter. That could be looked as splitting your commission with a non licensee. The perception of an inducement is vital.That is my two cents worth.

I was also thinking about doing this. We recently got our license and we figured this may be a good idea but wondered if it was "frowned upon".

This is really valuable advice for an entrepreneur! If you build everything you're doing around fear of what if fear, you really limit your potential. Sometimes you can even take yourself out entirely.
