I guess I shouldn't care since I want it sold and I'd be happy if he brought me a qualified offer. But it just rubs me wrong for some reason. Maybe because I've just never thought about it before.

There is a free classified local websight that most realtors put their listings on and I just came across an agent, who I've never heard of, that has my listing with my pics, etc. with his name, brokerage, phone number, etc. as if it were his listing.

So, more power to him? Or would this bug you at all? TIA!

That would not be permitted here. The only way that you can advertise someone else's listing is with written permission. The client has chosen who they want to be marketing their property and the only way I know that it is being marketed in a legal and professional manner is if I control the marketing.

Check with you local board unless they have written permission they can not do that. Call them and ask them what's up.

I got my career started advertising other agents listings in my brokerage. My broker was fine with it and I just had to call and get a verbal ok from the other agents in my ReMax brokerage.

But to advertise another agents listing from another brokerage (because the broker actually owns the listing in the USA) in this area without permission is a MLS violation and you can be fined or suspended.

That was my understanding too, that no permission was required from the listing agent and this would not constitute a violation with the local board, but that HUD does have specific guidelines for advertising. I'm looking for the link to those guidelines, but not seeing one right off. Please correct me if I'm wrong.

Nope, should not happen. With permission is one thing and it should be disclosed that the person is NOT the listing agent, the listing broker should be referenced just like in IDX. I would not stand for it. This guy could then use your pictures, your descriptions, etc. to get more listings cause people think they were his listings..know what I mean? If they like the pictures and want the same agent to represent them...

UPDATE!

Thanks everyone for posting! I called our board's legal hotline & confirmed that it is against our state law. I emailed the agent & asked him to remove the ad & referred him to the legal hotline if he had any questions. This morning, the ad is gone.

Thanks again for helping me see the problems with this situations.

HUD wants everyone to advertise their listings. They have even said that you don't need to ask the agent for permission since it's in the listing agent's agreement with HUD that anyone can advertise.
I've had other agents advertise my listings in Craigslist without my permission. It's against the rules. At the same time, if my listing is getting more attention, I will not make an issue of it.

Same here, except for the listing brokers ID part. Since some have mentioned HUD homes, I looked into it. HUD might be OK with it, but the Association/MLS rules that I am a member of require I get written permission from the listing agent.

Around it's good practice to get permission from the listing agent / broker. However, as long as it's listed on the MLS any agent can promote the listing but are required to include the listing brokerage and it's contact number.

Talk to your broker and see what you can do. They last thing you want is to have somebody who could be interested in your property get the wrong information on it.

The biggest problem in Utah right now is that our inventory is so so low. HUD homes listings used to be about 80 in the county and are now down to 30-40. Agents doing Craigslist advertising are really scrambling.

Glad that you were able to find a happy resolution. I know I'd probably be p'ed off if someone decided to advertise my listing without my permission.

I don't need to give permission, other agents know they can advertise my listings but must indicate seller is represented by my firm but can say for example let me arrange a private showing of this fine home, or some such thing.

One thing I fought against for years was the MLS rule against having the for sale sign in the photo on the MLS, what was the real purpose of that, never did get a truly good answer.

we are nto supposed to have a for sale sign in our photos, but we hire sign companies and photographers....sometimes, we get photos with a sign in them and the mls regulations state that one of your photos must be an exterior main photo....nobody enforces that one as far as i know...they will fine you if you dont have exterior main though.

i dont care if you advertise my stuff......bring in a buyer.....for the most part, it is a waste of time


you sell shoes by driving a client around to different shoe stores looking for the perfect pair of shoes for them, then hopefully, they buy a pair....or you can own a shoe store that people visit....i would ratehr own the store

I absolutely DO NOT care if someone spends their scarce resources and time on advertising my listings. Are you kidding? They bring in the buyer. I get my commission. My broker gets his cut. What's the problem? Its a no brainer. Its just business.

Under Chicago Association of Realtors, one can only display other Agent listings through IDX or VOW approved solution on their own website. But posting a free classified listings of other Agent as your own is questionable.
