Are you a Salesperson or an Agent
This question has arisen in jurisdictions "where the law of agency prevails", as it has been suggested that a salesperson’s primary duty is to sell the product/property, whereas an agent’s primary duty is to protect their client/principal.
That the relationships are distinctly different, with regard to their primary duties and a representative cannot be both.
Might such a relationship be deemed a conflict of interest?
The question arises, as how you view yourself ... are you acting as salesperson or an agent?
