Are there laws similar to DNC in regards to emailing prospects? For instance if I email FSBOs on a buyowner site could I potentially get fined?

Unsolicited emails must comply with the CAN-SPAM Act.

Your brokerage should have a do-not-email list (since the opt-out will apply to your entire firm, not you) and you can't email anyone whose address is already on that list.

There is no law that I'm aware of (but I'm of course not a lawyer, and local laws may vary) that would outright prohibit you from using the FSBO site as a source of leads. However, that site's terms of use may prohibit you from doing so.

Don't know if there's a law but if enough people report you or your domain for spam violations you could find yourself being blacklisted by places like AOL and others.

Emails don't work anyway. The FSBO sees the regarding line and deletes before reading it. Just call those on the DNC. This is a relationship business.

We do not have a DNC for email in my area. I did experiment with this before and I found I had a 10% response rate to my email messages.

Of those that did response nothing ever did developed into a listing. If I kept at it I'm certain I could have got a listing at some point but the effort to results ratio of this approach just isn't worth it.

Thanks for the responses. While results may vary, emails have been great for me so far and I will continue to use them along side calling expired listings. My only concern is that I stay within the law when doing so.
