ok we sold our home here in NJ...the closing was supposed to be Friday July 29th....we are moving (buying a home) in Oklahoma...last I spoke with my lawyer she had not yet received Title Search results or the Survey...now my furniture was shipped out by moving trailer on Tuesday July 26th and my horses were shipped to a friends house in Oklahoma also...hubby and I are living in basically an empty house...we both left our jobs so there is no income coming in...what the heck can we do to get this closed...from the beginning everything on the buyers end was done without urgency or just NOT DONE at all...basically his realtors and lawyer have sat on there hands thru the whole process...the buyer allowed us to pick the closing date...he said we could close anytime...If we dont close soon I'm gonna need some serious therapy

What did your realtor say?

What did your realtor do to make sure things get done for a scheduled closing.

You have talked about "his realtor and lawyer and your lawyer" but not about your realtor. It appears you have one too few realtors and two too many lawyers unless one is the the closing company.

Did you have anyone representing your real estate interest? A lawyer certainly does NOT represent your interest in real estate transactions that are key to getting a sale closed.

How do you know at this time if you will actually ever close? Your agent, if you have one should be able to answer all your questions.

If you have not extended the contract, there is no contract. What was the execution date of the contract? In my area it takes about 45 days to close a transaction that involves financing.

Here is what I would do:

1. Consult with your attorney.
2. Have your realtor submit an extension of the contract amendment to the buyer's agenta asap.
3. IN the amendment, put time limits on when the buyer will order the survey if one is needed.
4. Put time limits and if you cannot negotiate reasonable limits, put the house back on the market.
5. In fact, I might just put the house back on the market to get a backup contract and go to the back up if the second contract closing date is not met.

I would never recommend that you not consult or use an attorney. In Texas that will get you out of the Real Estate with a suspended license quicker than anything. Consult a good attorney that is working for you as your agent.

I would bet that the buyer is having buyer's remorse and will not buy your house.

You need representation by a professional Realtor.
