Don't get me wrong as I used to live in Texas. But how do foreclose on deployed military for $977.55. For this to have happened in the first place is just WRONG.

Soldier that lost home to foreclosure gets it back

Now comes news that a soldier from suburban Dallas that was foreclosed on in 2008 for delinquent homeowners association (HOA) dues will get it back.

The Dallas Morning News reports that the homeowners association in Frisco, a northern Dallas suburb, foreclosed on Michael and May Clauer in May 2008 when the family was delinquent on $977.55 in association dues. Under state law in Texas, an HOA can foreclose on a property and sell it at auction to recoup delinquent fees.

When the foreclosure happened, Michael Clauer was an Army National Guard captain deployed in Iraq. The family owned the house outright, but it sold at auction for $3,201, before it changed hands in May 2009 for a sales price of $135,000.

The new owner and the Clauer family aren’t disclosing the terms of the deal, but the family will regain ownership of the two-story brick house after a court-ordered mediation session.

I believe it. I am still amazed at the powers given to HOAs and no in the government seems to notice. A good percentage of our area foreclosures are because of HOAs.

I did not know an HOA could foreclose. I knew they could lien. Unbelievable. Gatekeepers. Can't stand them.

Around here an HOA harrassed an lady whose husbaand was fighting in Iraq. Why? She had not taken down the Christmas lights. She said, her husband was comfortable going up the ladder, but not her. No sympathy from the HOA. Dastardly organizations.

I have condo listing. It cannot be financed because of all the short sales and delinquent payments. I wish the condo association would foreclose on some of these nonpayers. You can't give the property away due to the delinquencies.

Back in 1989 I was 13 when my mother got cancer and died. It was just the 2 of us. After she died, I learned that the HOA of our condo had initiated foreclosure while she was in hospital for 6 months because she owed $5,000 in fees. They took the condo - all she owned and her legacy to me, over $5k.

They do not care. At all. And yes, they were aware of our situation.

I heard this story on NPR. Texas is the worst for HOAs doing this. And this home was paid off before the HOA took it for non payment of dues. The soldier did get it back because the Fed Gov does not allow this for deployed servicemen and women. There is a spacific law to protect them while deployed overseas.
