My question is in New York City the new tennant will pay 15 percent of the first year rent to you as your comission right? Can you charge a flat fee of ??? if you want?

I'm not sure of NY law but in Florida all fees are negotiable. You can charge what you want,as long as your Broker agrees. I do'nt beleive any state allows price fixing, it's a free enterprise system. The consumer deserves competative pricing, it makes things/services more affordable.
You need to check with whichever agency regulates the rental of apartments for a fee, NY department of real estate.
I'm sure the city probably also has some sort of regulatory agency(ies).
