Desperate!!! want out of my contract

Just want to get information on getting out of my contract with my current agent. I am aware of the unconditional withdrawal, but not sure if that is in my contract. Our agent has been anything but great and extremely flaky. We live in Las Vegas and not sure what our options are. I think we signed a 90, but not sure. We have had our house listed since mid April. Any advice? Our new house is scheduled to close on the 28th of June and we are extremely desperate. Signed non-contigent on the new house. Thanks!

Unless things work differently in your area than mine once you're in, you're in for the duration UNLESS your agent or his broker will give you a release.

Can I just tell them I want to take the house off the market all together. And maybe put my own ad in the paper for a lease with option? Or to even just rent it out?

You need to read your listing contract very thoroughly.
In some cases you can become liable to pay the full commission if you make the property unmarketable for any reason or lease it.

Yes you should read your contract carefully. Renting it could be a viable option, but understand that this may make it more difficult to sell.

One key ingredient of any successful sale is regular communication between agent and seller. Have you had any conversations about your house lately with your agent? Since you are likely to be stuck with this agent for awhile why not review the sales activity in your neighborhood, adjust the price if necessary and have him tell you his marketing plan for the next few weeks regarding your house. Get his Broker involved if you can't get his attention.
