Anyone know what happens to deals you have in escrow if they suspend your license??? I recently got a complaint from a client to the department of real estate. It was for something that wasn't my fault. Her AC unit got stolen after close of escrow so she filed a complaint. I spoke to the deputy commissioner about it and he says i should have nothing to worry about and that he will be reviewing the files next week. I currently have 2 deals in escrow... if for some strange reason they do decide to go with disciplinary action on me, what will happen to my deals? Will I be allowed to close on them? Will I still get paid? Anyone know?

Don't worry about it, by the time they get to your case, your deals will be closed, and it wasn't your fault anyway, unless you stole them smile

her complaint was that she believes i didn't do the final inspection for her... she requested me to do the final inspection for her because she was from out of town and couldn't. I've got emails from her requesting me to complete it for her. She signed the final verification form. I also managed to get lockbox records from the listing agent that showed I completed the final inspection... i remembered seeing it there on the day before close of escrow...lesson learned... never help a buyer complete a final inspection.... She didn't even notify me that the unit was gone until 6 days after close

I sat in while the Real Estate Commission listen to a similar complaint from a Buyer that the Fuel Tank was empty, even though the Guage said full. The Agent did not have Clark Kent's X-Ray Vision. Case dismissed!

The R.E. Commissions hear all kinds of whining, and it's their job to sort through it all. There are some legitimate complaints, but the bulk are Citizens exercising their right to gripe and be heard.

And the Commissions take their function seriously, and don't take the matter of messing with someone's livelihood lightly.

I would not worry about it. You're not suspended unless they say you're suspended.

I personally worried about some mal-content's complaint that she was missing an extra buried septic tank . . . . worried about it for over 14 months, and then the case was dismissed in about 7 minutes. Had someone been able to read the American-English Language, they never would have filed.

Doesn't your Buyer have Property Insurance to cover thievery? She ought to have purchased Coverage at the time Ownership was transferred.

Yeah, she had insurance... she kept saying she didn't want to file for insurance because she didn't want her premiums to go up.. before filing the complaint, she went to my broker and demanded that we pay $2,800 for replacement of the unit... after we found proof that I had completed my inspection, my broker turned her down. that's when she filed the complaint.

Respectfully file your proof . . . . they probably won't even have a hearing. They've got bigger fish to fry.

Failing to Notify her Insurance Carrier of the loss is a bit of a problem now. Had she notified them immediately, they'd probably have granted immediate coverage. Now, too much time has passed to investigate.

Were the Police ever notified? I thought Police usually investigate things like that?

I wonder why do I smell a weasel looking to get a New Air Conditioner paid for by someone else? I wonder if the people who sold her the new one kept a record of having also removed the old one? Must be the Cynic in me.

funny thing is, her old unit was a very small unit... it was probably only up to my knees in height... only the condensor was stolen and that's all she would've needed was to get that replaced...she sends my broker an estimate to have a whole new complete AC system installed... it was for a 2 ton unit WITH UPGRADES....

Real estate commissions have many tools at their disposal from a warning to a fine to a reprimand. After that they can do a temporary or permanent suspension of your license.

The suspensions are usually held for very serious offenses.

The buyer is fishing for money. I can understand about the insurance complaint but generally you have to go above a certain amount for a claim before they start dinging you.
