I'm selling agent of short sale RE transaction in LA, California. I have 2 questions.
Q#1: After seller signed on the Agent Authorization form,(submitted to Bank of America)escrow officer added her name (typed her info) and submitted to BOA. Seller didn't acknowledged or authorized it. I can prove this by providing 2 different documents. Basically escrow officer altered documents after seller signed it. Is this forgery?
Q#2: I asked listing agent for Transfer Disclosure Statement package. She supposed to deliver them by 7th day, but I received them on 14th day after escrow opened. Anyway, on the TDS and other disclosure forms, I noticed that listing agent filled out all the forms with her handwriting.(CAR Winforms) She even print seller's names in her own handwriting.(right next to seller's signatures) on all forms. It's too obvious her handwriting matches the seller's print names all over the forms, even she put date next to signatures for seller, too. Anyone can notice it right away. This is the first time I've seen this. Is selling agent allowed to do this kind of stuff? Should I just let the buyer sign and return them? Should I ask Listing Agent to re-do them? Is it illegal?
