I have a listing ,out of state owners ,house vacant over 1 year ,managed by a property management co. for over 10 years, owners fired property management co. when I took the listing.
"I feel like im the property management co. for the sellers" owners not very cooperative , had over 6 offers most rejected. not sure if sellers are motivated although they say they want it sold for the price listed. plumbing broke in ceiling .water was everywhere 2 weeks ago. sellers still waiting for home owners insurance co. for response. I told them they need to take care of water issue on carpet immediately because subject to mold., sellers told me to get estimates on water extract. I gave them like 3 est. still waiting for instructions.I told them I am limited to what I can do . I am not a property manager, need to hire one. Due to liability I canot tell them what co. to use. Its up to them to make a decision of who to choose. still waiting for Homeowner isurance response. what would you do?
I don't want to be involved if any mold occurs on property and is sold to new buyer. Am I liable,would you still keep the listing? Sellers are hard to deal with , and very cheap to get repairs done and want me to do all the work regarding handling repairs. I dont want to give up .I feel used. "I am not a property manager" HELP.

Start billing them by the hour if they want you to do work not related to marketing their house.

You were hired as a broker; not a property manager.

There are some listings you're better off without; this may be one.

Dear Seller,

As per our previous discussions, I feel that it is imperative that you contract someone to extract the water from carpets (etc)

I will be more than happy to provide access/entry to the property for said contractors (etc)

My opinion:

Put it in writing asap... you don't want that liability...(i.e- seller coming back to you and claiming you didn't inform them and insidious mold rendering their property uninhabitable/unmarketable... blah, blah, blah...

In the event of a negative situation, you want to be documented...(phone conversations don't cover your hiney)...

Again, this is only my opinion and not to be considered legal advice... I feel strongly that agents should consult with their brokers FAR MORE THAN THEY DO... Remember they need to cover their hineys, too... ;\)
