We had a short sale on the go, i requested a postponement of the sale date while we were in negotiations. The buyer pulled out and we were ready to submit the back up offer but they wont postpone. My client is going crazy this morning trying to get someone to talk to at BofA. They have removed the short sale from Equator so i cant contact anyone now as the autho is not valid. I dont understand why they wont hold off on the sale when they know we have a back up offer.....

I never told the lender that the buyer back up until we had the approval, even if I got the approval and the buyer is no there I place it back to the market as an approved short sale, in the meantime to find a new buyer, if they know the buyers are no there, they will close the file and you need to re-open it when you have a new buyer if it is no set to foreclosure already.

if the loan is Freddie Mac or Fannie Mae no worries as they are reinstating these after foreclosure for just about any reason!

Hold on here! Can you explain how you can make them reinstate a property?

I don't think you can "MAKE" them reinstate the property. I think that is their new policy (Freddie Mac & Fannie Mae) - working additionally as a loss mitigation counselor, my last two assignments last week were to go and visit homeowners where foreclosure just happened and tell them they have one more chance to keep their home "reinstatement" after the foreclosure. They only had to meet three criteria 1) Have 20% more income than their monthly bills total on paper 2) Not have been previously denied for a loan modification (and even if they have, if they can show their financial situation has changed, this one can be bypassed) and 3) not have declared bankruptcy. I've gotten in touch with one of the two homeowners and they met all three criteria and Freddie Mac is reversing the foreclosure --

This Google Custom search may do a better job of searching the forums for some keywords than the old forum search does. The results do not include threads from the Asset Managers Forum however. To search that forum you will need to be actually in the Asset Managers Forum and you will need to use the old forum search below.
