So i lock this lady out, and the sheriff posts the notices. She hasn't moved an inch of anything in her 2000 sq ft home. I tell her that if she wants her stuff she needs to pay a moving company (i gave her 2 choices) and they will take her stuff to her and drop it off.

Well the eviction attorney calls me 2 days later and says we cannot tell her she has to use our company, and i have to let her back in herself personally to get her stuff in the 45 day period that we have to store it. I said what? then what point is there in doing an eviction? Not to mention the sheriff says he will arrest her if he sees her at the property at all.

The attorney says i have to hire a security guard to watch(paid for by the bank of course) for whatever times she wants to go get her stuff, or sit there myself.

Yes - that is the part that gets to me too. I have been getting post and store tasks on all of my pre-lists and seriously it is all junk in these houses. I have one that has no less the 1000 beer cans - even in the bathroom - just did a post and store. There has to be a growing number of law suits going on - we can not trash out, or prevent a former owner or tenant from having access to the property to get their stuff, even after eviction. I had a lockout - sheriff there - could not move anything out for 72 hours - had to post the property with my contact info - then the trash guys could come back 72 hours later if I did not get a call. I have sat at a property at 7am on a Saturday while a former owner SSLLLLOWWWWLLLY moved books and junk out of a garage - I brought a book - nice - read a good 4 chapters

I would contact the bank's eviction attorney and get their take on it, before doing anything.

We have it a lot easier in FL.

At lockout they just move it all to the curb.

We even have times where they consolidate all the PP to one room, put a lock on that room and post that they have 30 days to claim.

We list, get it under contract and close just after the 30 days. Trashout is just prior to close. Piece of cake.

Sorry to hear it is so tough other places.
