So I have been working a short sale since january 1st. We received an offer Feb. 1st and the bank just approved the sale.

The bank also stated that they would pay an additonal 5100 in commission cost.

I am wondering do I need to make an admendment to the original listing agreement to include that or does the Instructions to Closing Attorney form sufices for any changes in the commssion?

Personally, I would not consider it true unless the bank puts it in writing.

I don't think it's "Additional Commission" . . . . but rather the just the Commission that the Owner of Record had agreed to pay you (but with money he doesn't have) and which is now going to be paid by the Lender.

"IF" it does turn out to be "extra" then I hope that Lender has a few branches around here because I want to work with their Mortgagors.

When one of my listings went to a short sale, I submitted a new listing agreement with a higher commission to the lender.

If you've already submitted a HUD 1, make sure you submit an updated HUD with the higher commission.

Vermont - Yeah it's "extra" talked to the negotiator today and she said that however we can work that 5100 into the contract rather its by paying more of the buyers closing cost or increasing the commission its fine

loveofcreed68 - Thanks, I haven't submitted Hud 1... I am getting that back from the attorney tomorrow and I am going to submit it with the increased commissions to get the go ahead
