I have a home under contract in the Dallas, Tx area( me being the buyer). This is an FHA loan and we are putting down 10%. The asking price was 199,999, we offered 195,000, they countered with 199,000 and we accepted. Our inspection went relatively well, except for a few issues. We asked for a skylight to be replaced, some electrical to be updated, water heater issues to be addressed, and some A/C issues to be addressed. They did take care of the water heater and offered us 500. towards closing costs. we accepted because we like the house and maybe the repair of those issues will not relate to more than another 5000. out of our personal pockets. The FHA appraisal is this week and some of these issues may come up in order for the home to qualify. If this work has to be done before closing, I do not understand how when we do not have possession. How are these issues usually addressed?
i have caught him in two mistruths and he has not attended either of the inspections we have had done. I do not feel my agent is representing me well at all.

If the seller won't pay for them then the FHA appraiser will note things that are not functioning properly or up to standards. If this is the case the home will not be FHA approved and the appraiser will notate issues to fix and the appraiser will have to come out again delaying the closing.
At that point you will have to take a leap of faith and have the items fixed to get to closing if the seller won't pay or you can just terminate the deal and move on to offer on another property.
No legal advice and if your agent can't help ask for their broker to step in and help guide you.

I would get in contact with his broker and let the broker know that you are not satisfied with the representation you are receiving. Tell him you want a new agent to step in so that you can all avoid a messy complaint with TREC. Your agent has a fiduciary duty to you, and if he fails to deliver, you have recourse.
thanks again, we have the FHA appraisal coming up this week. I asked my realtor to attend, he said he would call to be notified of this event. Is this not part of his job? He states he has 35 years experience.

Where I come from, The FHA Apprasier works solo. He calls and schedules the appraisel with the listing agents office; he/she does not want agents there.
The appraiser is giving a report to the lender stating what needs to be done for FHA to insure the loan. Example- Fix the electric outlet or no FHA loan. Who pays for it? Thats negotiable. At that point your contract is opened to remedy the problem. Idealy the seller will correct the issue. If the seller can't or won't, then the buyer can do it if they choose to. Sometimes the agents involved will do it.

While your agent is there to represent you, it doesn’t mean he/she should attend your inspections. Inspections are the buyers INDEPENDENT investigation/examination of the condition of the property. Your agent isn’t supposed to advise concerning items on condition of the property although he/she is there to negotiate how/when/where your required repairs take place.
