I've come in contact with many buyers and investors that want great deals out there. almost every time i talked to them, thay all said send me something. I dont mind sending what they are looking for but i want some kind of commitment from them so that they dont go around and make a deal themselves or with some other broker.
How do you make them to commit if they don't want to sign the buyers rep agreement up front? or what do you need to go through initially so that you know that buyer you are talking to is serious and ready to go through the process?

Why would any buyer want to sign a commitment before you do any work for them?

What happens if they sign the commitment and then they find out you are lazy and are not providing much help?

That's what a buyer agency contract is all about. You say you will do 1...2...3...4... etc. and if you don't meet the buyers expectations, the buyer owes nothing and can look for another agent.

However, a retainer fee to cover expenses might be appropriate. A short trial period, to measure being able to meet each others expectations, might also be appropriate.
Work, what's best for you, your budget and your business plan.

I will show folks properties one day. It does not matter to me if we look at one home that day or ten. At the end of the tour (if I like them) I ask to represent them. This is where I whip out the buyers agreement. They can take the document home and look over, but I will not engage in ANY real estate matters until they sign.

I have spent too many weekends touring buyers around only to have them buy a FSBO. Within the last year, I have had four "clients" use the crap out of me and then buy with another agent.

Everyone commercial is a very different world than residential.

The buyers always want the deal and not the broker/agent. I don't send them deals unless (I) control the property or hold the listing on the property. In GA if they try to do a go around on a commercial property that owes commission I the broker can file a lien and halt the whole purchasing process.

Typically investors and developer buyers have a wide array of portfolio properties located in different areas and sometimes even states or countries away.

I have had many commercial buyers say " I signed an EBA with this broker and they were good the first 2 weeks and after that they were no where to be found."

A trial period won't work with them usually. So what I do is schedule a meeting and tell them a little about a few properties. Then I make them sign an agreement on just these properties that a commission will be owed if they purchase.

They like this as then they can have specialty brokers for each county finding them deals. I might know a lot about one county but squat in another and they want that local market knowledge to see the chances of a remodel or project flying in the area.

Want to make sure you get paid in commercial list the deals and they have to go through you.
