Any advice for my first eviction. The sheriff wants 20 people and a locksmith. Is this the norm?, what should I expect?, what do I need?, How much do I pay?, How much do I charge? Thanks

What is the size of the property? 20 people is not normal for my area, The most I have ever had with me was 4 people. I would double check with the sheriff's office.

You may want to check with your client also to make sure they are willing to pay for twenty people,(especially if something goes wrong and sheriff cant evict) sounds like it will be one huge bill.

When you do an eviction you have to pack up the homeowner? Just a maybe stupid question....I always naively thought the homeowner packed themselves.

I think it depends on the state. In NC: lockout rekey post 10 day letter. In SC: lockout and remove all personals to the curb

In FL they post it in the evening then start evictions in early the next morning. We have almost all of ours handled by a National Company and they provide the rekey and crew.

We have one Monday the 7th that was just a PP eviction. We have been waiting since January. Legal for seller kept saying they were waiting for the judge to sign.

In Missouri, the sherriff gives them notice (10 days, I believe) and then the set-out crew arrives unannounced at some point after that time has passed. All personal property goes to the curb and property is rekeyed.

So this tells me you guys move it all to the curb and sheriff can't leave until it is done. So 20 people means he'll have 8 show up and get the job done in 90 minutes instead of having 3 show p and the job taking 4 hours plus lunch. Just guessing.

I have my first eviction on Wednesday. They asked me to get a crew of 4 to 5 men for this eviction. How long does it normally take to do the eviction, rekey and cleanup?

It all depends on the mess you have to clean up. 1st you have to gain entry. I assume the police will be accompany you, which means they will go throughout the house with you to make sure nobody is about. Then you will have to write down items that are in the house so that everything is documented. Then you can proceed with the cleanout.

One more tip - take a digital camera and take plenty of pictures. Make sure the time and date stamp is activated. You might never need them, but it only takes a few minutes and could protect you from the occupant who claims more items than are actually there.

Not only will the amount of mess to clean up take time but if there is anybody inside the property that does not want to come out? I have had a few where the deputy has had to call in some back up police. One was a 3 story home built in 1920 that had a lot of hidey holes. Once the police arrived, they and the deputy chased the guy throughout the house. They finally cornered him in the attic. They then shot pepper spray in the attic to get him to come out. Took about 2 hours for the pepper spray to clear out they began the clean out. About 4 hours on that one. Another one they found a guy in the basement sitting on a bed with a gun under him. That took awhile to clear up. Of course I have had ones that took about 15 minutes. Just make sure that you stay away from the house UNTIL the deputy comes out and gives you the all clear!

BTW, the eviction went great!! Sheriff showed up, I had 20 people, broke it into 3 teams, top floor, main level and basement. It went sweet, I video taped it and an took pictures for liability reasons. Remember take plenty of trash bags.....Down fall did'nt like seeing the owners standing by watching, had to catch myself several times.:( But charged $650 per hour!! We were done in 3...

Update on my eviction...it didn't happen they had another company to do the eviction but called us later to do the clean up because the other vendor left the trash on the curb. How about that.

I'm hoping to revive this thread to get some update on the process for an eviction, how to do it, etc. A proposal being considered requires 'eviction' services. I'd really appreciate anyone's two cents into the whole process:

Who initiates the eviction?
What authority(papers) does the AM or Bank give you to initiate an eviction?
How much do you normally charge and what the AM/Bank will accept (and still come out ahead with a profit)?
Do all AMs/Banks offer CFK?
Do the Deputies/Police come automatically when an eviction date is set?
Do you think I should hop on down to my local Sheriff's office and talk to them?
Do you all have your own trash-out/clean-out crews? If so, how much do you charge for that service (and still come out with profit)? How long is 'stuff' allowed to be on the property (curbside) before you can legally haul it away?
Have you ever had a property that looked structurally dangerous to enter? If so, what did you do? How did you handle it?

Anyone can PM me too - I really need some good education on this one. In the meantime, I'll check VA Code.

Appreciate your help. (And, yes, I've searched around the forum and there are posts everywhere, but I'm not finding much up-to-date info.

Every state handles it differently, and in some cases, the actual process is different in different counties.
I sell REO in 5 counties. In one, the deputy posts the notice and is present on the eviction day. The property preservation people handles getting the doors open, then the deputy searches the property before allowing anyone else in. In an adjacent county, the notice is mailed by the sheriff's department to the property address and then a deputy shows up on the eviction day. In a third, once the judicial process is approved and a date set, the sheriff notifies you of the date and cautions you not to contact the occupant.

So the best suggestion is to talk to the sheriff (or their chief deputy) in every county where you work.

Here's how it's been handled in my experience in Ohio: the foreclosure attorney initiates the eviction process, and contacts the sheriff's department (I service 3 full counties and portions of 3 others, but all my evictions have been in 1 county). The attorney's office informs me of the initiation and I coordinate with the sheriff's office as to the date. This particular county is well versed in eviction procedures. Without fail, the deputies would have preferred to be doing pretty much anything else that morning, maybe even pulling their own teeth. Not because they're lazy or anything, it's just that they are very wary of what's going on and what to expect. I have been told to have a crew there for the lockout and move (the crews I use always document what they are moving into a storage unit--1 guy even had forms for the occupants to sign regarding various items and acknowledging that they knew where the items were going). Usually we have 5-8 people and they get it done in 2-3 hours--winterization, lock change, and move out. The deputies usually stay long enough to make sure everything is going smoothly and that we won't have any trouble from the occupants, then they leave and so do I. The crew calls me when they're done. I've only ever used 2 different crews--both have been professional and trustworthy--maybe I've just been lucky. I've seen them charge anywhere from roughly $1500 to $3500, depending on the size and scope of the job. I've been involved in 8 or 9 evictions; not a lot compared to some, I'm sure, but 8 or 9 more than I would have preferred to be in. Thankfully, most people take the CFK. I do believe that the sheriff's office would be the best place for you to start your research.

There are two deputies that handle my usual listing area. I have their cell phone numbers in my address book. They always let me know what the occupant has told them and when the deputy expects them to be out. I got contact info for my best crew from one of my deputies. Professional, on time and prepared. I hate evictions, can't stand them. I get a huge cup of coffee, and talk to the deputy the entire time. They always walk with me through the house while I take photos, and they do not leave until the crew is done. If its 4 hours, then thats how long I stay. The eviction attorney is the one that files it, and the deputy posts the property with the day and time of eviction. They can choose to give the occupant more time, and I always make sure I know the offical date.

After I reread my post, I realized that I should have specified that if any problems were anticipated, neither myself nor the deputies would leave. I've been very fortunate that the evictions I've been involved in have gone smoothly, with no trouble from the occupants except for one time, and that wasn't so much a trouble situation as it was people who just couldn't face reality. It still turned out OK. But like OverTheEdge, I absolutely hate evictions. I like the occupancy checks where I can report "Vacant."

At least, it seems there's an attorney involved. That was a question - do I file the papers (but then I'd have to have the bank's authority to do so).

So, do you have your own guys do the trash-out, winterization, lock change or do you use a local company?

Your guys put the stuff in storage? Really? Who pays for this storage unit? What happens when the occupants don't come get their stuff? I would have thought with evictions, it just goes out on the curb - at least, that's some of what I've seen in my parts.

I can only speak for Ohio, but here, I don't have to file any papers. The most I've had to do with paperwork is deliver notices that the occupants have to be out by such and such date, or CFK deals. The attorneys that I've dealt with have been pretty good, they've just been hard to get hold of from time to time.
The two crews that I've used for evictions were not quite "local" but not from the other side of the state, either. Both travel 40-50 miles to do the job. I have a regular trash out crew, but they aren't equipped to handle evictions. Back when I was really busy with REO (2005-2010), I used to get solicitations from people all the time who wanted to do trashout and eviction work. So I chose the ones I use and have never had a problem. I'm not a nasty guy to deal with, at least I don't think so smile and we've all gotten along pretty well. I have heard stories about the "stuff" being placed on the curb, but I've never actually heard of anyone doing it in my area. The crew takes everything to the storage unit and pays the first month. If the occupants want it, they go to the storage facility and pay that month's fee to get it out. The storage facility then refunds the original deposit back to the crew. If they don't get it back, then it goes to the landfill after a period of time, I think 30 days. OR, the occupants can choose to leave it in storage as long as the crew gets their deposit back.

No storage unit here. The last one I did, the deputy knocks on the door, tells the occupants we are here, the crew goes in, and starts carrying stuff out to the front yard. It was kinda wet, so they placed huge pieces of plastic on the grass and out everything went. The occupant was there and wanted the guys to load his moving truck - not kidding. Uh no, although anything they wanted on the truck was set on the grass next to the truck, everything the occupant wanted went out the door, entire house was rekeyed, windows all checked, we locked it up, I put my lockbox on, and we all left. The occupants finished loading their truck and left. Trash out and winterization were not done by them, field services did that the next couple of days.
