I am a new agent and I have a situation that I'm a little confused about. I am the listing agent on a home that is under contract. I am representing the seller only. The home inspection came back and the seller agreed to fix 4 items on the inspection report...the buyer agreed to this and we signed the repair addemdum. The repair bill was high but all issues were addressed. The re-inspection was yesterday and the home inspector said one item was not completed properly. However the contractor that completed the work for my seller said he completed the work as stated in the home inspection. So finally my question, is this a matter of opinion or are my sellers bound to satisfy the home inspector and redo and repay for additional work? Thanks for any help. (The repair in question is reglazing the windows)

You will have to get your broker or their attorney to look at specifics and how specifically repairs were written into the contract.

I generally do not let the sellers do repairs as they do the cheapest thing possible and the buyers hate it. I always get the credit and let the buyers choose the contractors so it's their fault if they screw up.

As a last resort you could offer a credit off your commission if the repair amount is small to keep the deal together.

In NC the windows have to be performing the function they were intended to, namely, keep out the weather and let in light. If the glazing is keeping the weather out then the job is complete regardless of what it looks like.

What is the problem with the glazing?

Thanks for the responses. I think from now on I will try and go with getting the credit and let the buyers do their own repairs. I think the problem was the home inspector didn't like the way the glazing was done but after thinking about it the buyers agreed that the sellers completed the repairs as stated on the repair request. After two days of limbo on this one it's finally worked out.

One thing I recommend to sellers, is to have the repairs done by a licensed, insured professional, who also warrants the work, with receipts given to the buyer at closing.
It might cost a little more, but it also provides peace of mind for the seller and the buyer.
The other sure fire way is to give a credit, if it's acceptable to all parties.

Inspector is responsible by the law to point what he thinks is wrong, but if the buyer is satisfied should not be a problem. By the way as many inspectors or contractors you ask, all of them will give you different opinion.
