Hope there are some New Mexico real estate agents out there to answer a question.
I have been looking at a property located within a HOA. No one can provide a current copy of the HOA rules. Does the state of NM require the seller to provide a HOA packet to the buyer?
I come from another state but this is what I expected:
Buyer makes offer and seller accepts.
Seller then has to provide a HOA packet. This will contain the rules on how the HOA is governed, its financial status, lawsuits pending, ect. The packet is from the HOA. The HOA may charge the seller for providing the packet.
Buyer has a set period of time from the receipt of the packet to accept it or can decline the purchase of property due to HOA.
Does this apply in NM? Is the process dictated by local customs rather than state laws.
