Hi All -

I am in the process of getting my RE agent's license in CA. I am also in the process of creating a partnership where a friend of mine and I are going to offer REO Property Preservation services, Home Inspection services, and home repairs/maintenance services.

I remember a comment from my own agent when I recently purchased a property in CA, and wanted to understand further implications.

When my agent referred me to someone (e.g., a pest control company or a home inspector) she couldn't take a referral fee, as it would be viewed as a Kickback, which would be illegal in CA. Likewise today I read that in CA it is illegal for a Home Inspector to do any maintenance/repair work on a home for 12 months after the date they did the Home Inspection.

So my questions are:
1. Would my having an agent or broker license be seen as a conflict of interest if I also was half owner of an REO PP business/Home Inspection Business/Home Repair business?

2. Would the fact that we are offering home maintenance services be a problem for us if we were also doing Home Inspections? (My guess is we would just be prevented from doing Maintenance on properties that we handled the Home Inspection.

3. If we offer REO PP, does that prevent us from doing Home Inspections?

4. If I get a RE listing, does this mean our company would be prevented from doing Inspections, PP, or Maintenace on one of my listings?

On number 4 banks have stopped allowing alot of that.Banks or asset companies were taking 1 percent of the cut of the REO listing so some brokers also owned lawn care,maintenance etc. companies and would bill the maximum amount to recoup profits.

The other items people say alot of things. I always go to the real estate commission as they are the ones that can come after me if I am incorrect and not my FRIENDS who THINK they know the answer.
