what do you do when you are dealing with an A. H.

Has any of you dealt with an agent or broker who doesn't cooperate with you? i'm currently dealing with a listing agent who's being an A. H.
He doesn't return my phone calls and when he decides to call, he acts as if he doesn't care if my tenant lease the space or not. i mean the guy has center pratically empty and i figure he should be happy that im bringing someone in his dead center.
How do you deal with this?

Kimco owns the whole shopping center and the listing agent works for Kimco.
should i contact the kimco headquarter and let them know what's going on?

Sure, but I'd play it cool...you may need to do deals with Kimco in the future and you might not know the whole story, so charging in like a bull can sometimes be counterproductive.
My question to you is why does your client want to go into a "dead center?"

hi, El! thanks for replying. now, the center is not completely empty. it has Home Depot, sports authority, and bunch of other small tenants. however, the longsdrugs just moved out along with other bunch of empty spaces. the reason my client wants to move there is because his currently business is located right across and he doesn't want to move farther away from that location.
my client did mentioned that im going to have difficult time dealing with the listing agents. this didn't come from my client only but majority of the tenants in the center pretty much agree with him.
how do you deal with this? i mean my client wants to move in to the space in the center and i called the listing agent 3 days ago and he still hasn't call me back.

How about sending him an email and Cc'ing his boss and your client. I've found that you sometimes can get an email reply when you Cc other people b/c if they do not reply it's now out in the open that they are not doing their job. It's not full-proof, but I have had some success doing this.

Yeah, but they own a lot of 2nd generation B & C class centers, so they should have room for some locals. Also, in today's world, not many nationals doing deals (relative to where we were 2 years ago).
Bab - What type of business does your client run? Maybe it's not a permitted use. It's not a tattoo parlor or adult bookstore is it??

it's going to be a bar/night club. i've talked with the listing agent about this and he said it would be a good fit.

I'm glad I asked the question.
Regardless of what the Kimco leasing rep told you, in the eyes of national LL's and national anchor tenants, bars/nightclubs are for the most part NOT a good fit as co-tenants....they generaly fall into the tattoo parlor and adult bookstore category of "non-desirables."
National anchors typically have language in their lease of who they will prohibit as future co-tenants in the center. That said, these anchor tenant leases will also spell out exceptions. For example, the lease language may say, "bars / night clubs prohibited, except for those establishments whose sales of alcohol represent less than 30% of total sales." That way, sit down restaurants with liquor licenses are permitted.
Anyway, I can't explain why the Kimco leasing rep said it was a good fit....but maybe he realized his error afterwards and is embarrased to return your call - who knows. I would prepare your client for plan B.

No, my client is trying to resolve the situation with the current landlord where he's at now. I think sending an email or any kind of approach wouldn't have any effect on the deal.
what i don't understand is how can Kimco allow an irresponsible agent to work for them. Everyone at the center can't stand the guy's attitude.

Frankly, there are plenty of idiots in commercial real estate, just like in other industries.
I represent a tenant (a food franchisee) that wanted to go into a shopping center where a closed down store of the same concept was located. The franchisee is a multi-unit owner with years of experience and excellent credit, and he really wanted to re-open this space as he would get it on the cheap...no build out cost (as it's already built) and there's a reduced franchise fee for re-opening closed stores.
The Landlord refused to lower the rent - it's been sitting vacant for 6 months....and to top things off, heavy road construction will start this summer in front of the center to build a bridge overpass over the highway. We proposed a reduced rent to the LL during this road construction - they wouldn't budge. This is a national property owner that's in financial trouble and they wouldn't cut a deal. Who knows why - it doesn't make sense....but it is what it is. I've made all the calls and sometimes you still don't get it done...just time to move on. I would recommend the same...don't get too hung up on this deal.
