...more of a disclosure thing, really.

My client is considering selling her place because she is uncomfortable / fears for her safety with a neighbor who is not 100% stable, something which will be noticeable to any buyer once they get moved in. What kind of disclosure would something like that require, do you think?

Well...bit of an uncomfortable topic...but since you asked.

As far as I'm aware, there isn't any disclosure necessary...and to disclose something like that would probably hurt your sellers chances of a smooth sale for top dollar. Anything beyond that, and I would ask your broker or an attorney and get their take on it. If you're uncomfortable, don't take the listing.

That's my .02 anyway...

the new neighbor might like the person taht your seller feels is unstable....

a coin has 2 sides! you only hear one!

the neighbor could be stable and the seller unstable. who knows....i dont have a degree in that sort of stuff, but i can sell their house if they want.


it is not my job to find out how "nice" (how do you scale unstable?) a neighbor or person in the community might or might not be.....my job is to sell the house


if htere is no disclosure form for it, i would not make one up...that could be practicing law;-)

yeap - i don't think that is a disclosure issue? I noticed a long time ago many people dislike someone because of specific event and who knows that event might not even bother most people

I had an appointment yesterday and the owner was home - after my client left the homeowner told me he didn't want to sell to my buyer because "he is an A$$hole". But honestly i like the guy?

It might be your client who is unstable. Sometimes the finger pointers are just putting up a smoke screen.

If you start disclosing things like that, good luck selling any home. Most of us have something we don't like about where we live but that's opinion.

My co-worker had a listing with an unstable neighbor. This guy would show up every time an agent showed the home. He was usually drunk and would yell telling people he owned part of the land/home and that he would not allow the sale to go through. Of course, he had no ownership interest. I showed the home once and when he showed up and went into his rant I showed him a copy of the title which he was not on. He lost it and was threatining us so I called the police. Needless to say my buyer didn't want it. I think it eventually sold for a significant discount to someone who used it as a rental.

The owner should have hired an attorney to write that neighbor a letter, and perhaps have it served by the constable. Would have cost some bucks but maybe the guy would have settled down if he was facing a lawsuit.

The guy had no money so it didn't make sense to file a lawsuit.
Many things were tried but the guy was a drunk. He didn't care.
The police were called every time he came out and he spent a few days in jail. Each time he got out he continued his harassment. I felt bad for the agent as it was a nightmare listing. She had to warn agents about this guy.
