I'm a seller that would like to cancel a buyer's contract that is 7 days into a 45 day day escrow. Buyer has not removed their inspection contigencies or their 30 day contingency to sell their home.

How can I (the seller) get out of this contract to stay in my home?

Have your agent review the contract and if they are past any deadlines, serve them a notice to perform. If they do not submit their removals, then legally you have the right to cancel the contract with them. There is no other legal way to cancel the contract with them, unless they do not perform their end of the deal.

In California, if you use the standard CAR (California Association of Realtors) Purchase contract, once the buyer has past any timeframes specified by the contract you must issue a 24 hour notice to perform to the buyer, if they do not then perform per the terms of the contract the seller can then cancel the contract. You should talk to your agent to confirm that this is correct for your particular situation.
