I just sold my condo. I disclosed everything I knew that was wrong with the house. The seller had a home inspection and found problems but we never agreed to fix the problems. Closing was yesterday and on the day of closing after it officially closed they found a leak in the copper tubing for the ice machine. I lived their for 5 years and never had a problem with it. I did pay for a home warranty for the buyer. Should I be liable for the expense to fix the problems?

First I would read up on the home warranty papers to see what your warranty covers and to see what period of time and who it covers. As long as you were honest and disclosed what you knew about the property I wouldn't worry about it. Did the home inspector take a look at the line during the home inspection? I would be glad that it isn't the roof leaking or something big like that! I would wish the new owners well and say that you didn't notice any leaks when you lived there and now that they are home owners they will have to recognize that unfortunatly these things can happen.

Thank you for the advice. The home warranty does cover leaks however I am unsure as to whether the water damage from the leak would be covered. As a good faith I have given him the money for the deductable. I just want to make sure he cannot take me to court later.
