I just signed a lease with new tenants for two years, but I'm suddenly itching to sell. What are my rights... what do I tell the buyers- - do they have to honor the lease?
Is there a law about this? (I'm in Park City, Utah, by the way, if it makes a difference). I looked over the lease, and it says nothing about it. I've listed it on Craigslist and people are interested but want to know their rights. Anyone know? Do they have to honor the lease, or can they kick out the tenants or increase the rent?

I do not know the laws of your state. However here in Florida yes you can sell the property. However the new owner would have to accept the property with the lease intact. Also here in Florida residential leases can only be for a max of 1 year.

If your state is similar then you might want to talk with a real estate agent familiar with selling rental properties. For selling that way the value is in the income not comps And generally the highest selling price is not as high and selling to an owner occupant.

Selling with a tenant is by far and advantage here in Las Vegas with all of the investors coming through, especially if the home is priced fair, and the lease requires the tenants to pay market rent for the property. There are no laws restricting the listing of a property with tenants. To get top dollar you need to market to investors in the newspaper, home magazines, etc

by the way, the lease has to be honored completely by the new buyers. I would inform the renters that you would like to sell and you never know they may want to go somewhere else anyways. Once you accept an offer on the property it usually takes about a month to close, you could use that as the renters final 30 days, given that they agree. Make it attractive to the renters, give them a free month if they get out sooner, it may be well worth it to you. Thos are good suggestions to try,also next time have a right to termination clause in the lease so if you decide to sell the tennants will have to vacate with 30 days written notice if that is the desire of the new buyer.

I wouldn't be advising potential buyers of there rights,could you say lawsuit and litigation.What if you tell them the wrong thing,you could be sued for damages.

I would tell them i am not sure and to consult with an attorney familiar with tenant laws.

You could go to an attorney yourself and get a professional opinion where they will review the contract to see what your options are.

I am in the same boat, my tenants lease expires in Feb. and I am ready to sell! However, other realtors have suggested to offer them an incentive such as paying one month rent for them if they decide to move once you sell the house.
Try that, maybe it works.
