I signed a listing agreement on 9/28/2006 with a broker but my listing does not start until 10/9/2006. Is there a way that I can cancel my listing agreement prior to 10/9/2006.

More detail:

I have received a job offer post 9/28 and I am at risk of losing my home sale benefits unless I use go through the relo company and use their preferred agents.

I also feel mislead by the broker in that I asked them specifically about the possibility of a job offer and relo package and asked if that would cause any issues with listing now and the answer was no problem the relo comapny will always work with us. Well that is not the case and I now have a feeling that the broker new that.

If the relo company told you that you have to use their preferred agent they are LYING to you. Your current agent must agree to the referral fee for the RELO company usually 30-35% in order for you to get your benefits.

I agree to a point with Paul. Although the relo companies can not require you to use their preferred agents they can and sometimes put certain performance requirement into it. For example some require the agent to have at least 3 years experience and or sometime a min number of transactions etc.
