There's a seller who has not listed his property and he is interested in selling to his current tenants.

I specialize in creative financing and have a business partner who can help get these tenants financed.

The seller says that he is willing to give me a commission should I get his property sold to these tenants, so I'm wondering what kind of contractual agreement would be best to both protect myself, secure my profit, and define the situation in writing.

I would think that a simple commission agreement would be enough. You could just have the seller sign a listing agreement. It will still apply if you don't enter it onto the MLS. Just make sure the terms are in the agreement.

I agree, I think a simple listing agreement would work. Do you have some sort of FSBO commission agreement as a standard state form?? This may be a better option.

It might be a good idea to make sure that you are also protected in the event that the sale doesn’t go through with the current tenants and the seller wants you to find other buyers. IMO

commission agreement, then a sales contract. Nothing special.

If he wants you to find other buyers, a listing agreement is in order.

personally, i would list him as normal and go through the process with his current tennants. That way if it goes through it will show on the mls and be used as a comp. also, if it does not go through, you have the listing already!
