Hello. I'm still a newbie agent in LA and have a question about proper protocol...

My siblings and I inherited a small piece of land in FL that, because of restrictions, can only be sold commercially. There has already been an offer for the land by the business owner of the property next to it. In LA I have to disclose owner/agent status, but since I'm not a FL agent, do I need to disclose this? I've perused the FL statutes and couldn't find anything referencing a situation such as this. Any ideas? I don't want to inadvertently violate a rule that could later cause a problem for me.

I appreciate any suggestions.

Even IF you are not required to disclose the LA License, it's not going to hurt you to do so. You are not purporting to be any more of an Expert on Florida Real Estate than the Buyer is; but you may be a more astute bargainer.

Before accepting this Neighbor's Offer, I think you and your Siblings would be well advised to become acquainted with the local values and the extent to which the "Restrictions" you speak of are a Detriment to some; but may actually be an Benefit to others.

I would pay a Local Realtor or an Appraiser to prepare an independent valuation BEFORE entering into negotiations with the Neighbor.

Commercially is a GOOD thing because generally you get much higher value than residential.

As a commercial broker I would tell you you need to define that lands HIGHEST and BEST use to get the most money when you sell.The business next door has an interest but you might get more selling to someone else.

Respa laws do not apply to commercial transactions.

What size is this small piece?? What size and shape of the lot among many other things will determine it's potential.Post and I can give you some ideas.

I agree with Vermont, even if you don't have to disclose it wouldn't you rather just be safe?

I think you have to, I think it depends on the state law. Ask you agent.
