I was wondering if someone could see if im right in my answers

Honesty is the best policy
Amanda is new to the real estate industry. She has worked as an associate for six months and has
completed three transactions, one in Crestmont and two in Parkwood. She is eager for more work.
Mr. and Mrs. Bolton want to move to the neighborhood of Parkwood. They contact associate Amanda to
help them locate a property after seeing her advertisement on a bus bench in the neighborhood. They
have specific reasons for wanting to move to Parkwood and express their interest in working with an
associate who is knowledgeable about the area. They ask Amanda about her experience in the
neighborhood.
How might Amanda respond to this? Discuss.


Since Amanda has previously conducted three prior transactions and assuming that they are all in good standing she should be able to use them as referrals. Also with the 2 transactions done in Parkwood she should have an understanding of the neighbourhood and what it has to offer the clients. With all associates new or old she is bound by the same practices that her peers are so her clients can rest assured that she well perform her duties too the best of her abilities and what is required of her.





There’s a limit to obedience
Mr. and Mrs. Sidhu list their home for sale with an associate, Sam. After two weeks on the market, Sam
calls the Sidhus to make an appointment to present an offer. He reaches them on their cell phone, and
learns they had to make an emergency trip to a remote community on the East Coast. They will not be
back for another month. The Sidhus ask about the offer, and upon hearing the details, express their
satisfaction. They instruct Sam to sign their names to accept the offer, and to add his signature as the
witness.
Can Sam, acting as the Sidhus’ associate, complete the contract in this manner? Discuss.

In no way can Sam complete the contract, he would be breaking the law. Sam has a fiduciary obligation to act in the best interests of his clients at all times. By committing an act of fraud he would not be acting in the best interests of his clients. He should inform his clients of this and it is not possible to do so and try to resolve the problem in an other manner.

Care and skill
Associate Len and his colleague, Astrid, are talking. Len is recognized as the brokerage’s condominium
specialist. He has taken several condominium courses and has been working with condo clients for 10
years. Astrid sees the benefits of marketing herself as a specialist too. She has a strong interest in
acreages, and, having grown up on a farm, also knows something about them. She asks for Len’s advice
on a tag that she has come up with: “Astrid, the enthusiastic acreage expert”.
If you were Len, what advice would you have for Astrid?

I would have to inform her that the use of her tag line is not in her best interests since it can be view as untrue, since she has not yet become an expert in the field of acreages. She might Consider another tag line such as “Astrid, The enthusiastic acreage associate”. Upon building more experience and knowledge she may change the tag line to her original idea.


Disclosure of dollars
Mr. and Mrs. Johnson have contacted Lila, a real estate appraiser, to provide them with a formal
appraisal of their home. They are separating, and require the information for settlement purposes. Lila
makes an appointment to meet with the Johnsons and examine their property. During the meeting, the
Johnsons tell her that they may be selling their home, and ask her to recommend a real estate associate.
List the procedures that Lila should follow to properly disclose any referral fee that she may receive


Lila has an obligation to disclose any remuneration to be received as a result or the agency relationship from a source other then the industry members clients. With this she has to be sure that the referral is going to an brokerage with the capacity to handle the Johnson’s needs. Failure to do so could create a conflict of interest.



Material latent defects
Associate Chen is working for buyers who are interested in purchasing a residential investment property.
Chen has found a renovated raised bungalow with a basement suite, complete with a separate entrance
and nice large window to facilitate escape in the event of a fire. The current owner also built an extensive
four-season sunroom at the back of the house, proudly indicating to Chen that he completed all the work
himself. The property is classified as a single-family dwelling.
Identify the possible disclosure issue(s) in the case.

The fact that the work on the sunroom was done by the home owner could have issue arise in the quality of the craftsmanship. This should be inspect by a qualified home inspector to assure that no issues are present. Also with the basement Reno’s some hidden problems could exist and should be inquired upon. There is also an issue of how the house is listed since it is clearly not a single family dwelling.
The agent has a right to discover the Material latent defects so that they can be fixed or disclosed in the event of a transaction

You probably shouldn't post more assignments here.
It would be better for you to pair up with another classmate.
Also, people don't like reading lengthy posts.

Your answers are generally ok.

The honesty Q: An agent should be frank about background and not misrepresent the extent of knowledge or experience.

The limit to obedience Q: without written authorization to sign for a client, such as a power of attorney, an agent cannot sign for the client.

Care and skill Q: Any advertising should not misrepresent an agent's qualifications.

Disclosure of dollars Q: If an agent makes a referral that could result in a financial benefit to the agent, that should be disclosed to a client.

Latent defects Q: Homeowner addition makes having home inspection prudent; also must see if work done with proper permit. Fact of additional entrance does not mean it is no longer a single family residence.
