Can I fire my agent?

I need some advice. I just want to know if it's legally possible to fire my real estate agent AFTER I've signed a purchase agreement for a new home.
Following the purchase agreement signing for the new home, my agent and I could not agree on a commision for the listing of my current home. So I am listing my current home with a different agent. The first agent is now behaving like a 12 year old. Can I replace him (or dump him) as representation for the house I am buying?

Dear Gopher,
If you cannot resolve your problems with the agent call the broker. With that said, I hope switching agents doesnt hurt your transaction.
Working out differences with the agent would also be prefereable, but if he's one of these unprofessional hacks tell the broker you want competent representation.

Just because you two couldn't agree on a commission rate to market your home I don't see that as a valid reason for him or her not to get paid for their work in helping you buy your new home.
After the closing they will be out of your life; deal with it til then.

Are you talking about an agent representing you (as a buyer) in the purchase, and a separate one representing you as a seller? If so, then if you haven't agreed on fees, you probably haven't signed a listing agreement. There is nothing wrong with hiring another agent to represent you in the sale of your property.
Kind of like getting a tax atty for my taxes, but also getting a trust atty to protect my assets. Each has a separate duty and obligation to you.
I'd ride out the purchase, but keep in close contact with their (the agent's) broker

He can't seem to come to grips with the fact that the two transactions are separate. His take is that all the work done to find me the new home automatically precludes me from hiring someone else to list the current home (or even to negotiate with him on the commission for the current home sale.) It's just petty and I don't like it. Gopher

Good question, Carter. If the new listing agent can't be strong enough to negotiate his own fees,(or maybe he doesn't feel he is stong enough for what the market is paying agents) how strong will he negotiate for the seller when an offer comes in? :rolleyes:

Campion... Isn't if funny that.. "THAT" is the most important point, sellers always seem to ignore.... until low ball offers start rolling in and they are ask to sign up to them...
Then they wonder what would have happened with a more qualified and forceful agent... but it is too late...

Thanks! Gopher Well, your agent already has procurring cause and will earn the commission on the transaction, whether you fire him or not. I doubt any other agent would want to come in and take over handling the rest of the transaction and not get paid for it. Call and complain to the agent's broker. A manager will have to handle the rest of the buying side for you. You have every right to request that. You can list your property with whomever you want. There is absolutely no obligation to list with the agent that you bought through. I often have to go in and clean up the mess - that some discount broker has left of a listing - after the client purchased a home through another broker. :rolleyes:

I think most of you missed the actually Q AND scenario.
I would speak with his broker about the way he is behaving, especially if its making you uncomfortable.

Thanks all. FYI, the commision difference between the old and new agent was 1% (5%, instead of 6%). Also, my current house just sold in 3 days exactly as I expected it would. Easy money for the new agent. And, I have to tell you, the new agent was incredible compared to the old. In retrospect, I feel like I should have acted on my insticts long ago and dumped the old agent.
