I received a new listing , the old agent who had it under Fremont . will not release it from the mls. I have talked to him twice. Today he said he would release as soon as I sent him a copy of my listing agreement. per contract I have 24 hours to get it in the mls. has anyone else come across this lately. I never have a problem with giving up a listing when a new asset com takes over.... this is just crazy to me. grrrr.

Usually hes notified that he has to pull the listing as well.

I had the same thing happen last year with a Fannie that the MI company paid the claim and took the property. The Fannie LA waited 3 or 4 days to cancel his listing. I just stuck it in the MLS and let him deal with the phone calls. He finally did cancel it.

Here in the Atlanta area, I just put the listing in the MLS and email the MLS the new listing agreement. Then the MLS generates letters to both Real Estate firms. The other is force to withdraw because you've sent them the newest/recent listing agreement.

I don't even deal with the run around.

our mls will not let a property input if it is already listed in the system. and according to my contract they want the property listed in the mls within 24 hrs

Sounds like you need to send a copy of your listing agreement to your board and ask for an intervention. My local board will fine an agent who doesn't remove their listing when it is no longer valid.

Ok the other agent wants a copy of the new listing agreement. Why not send to them?

I hate to take the other agent's side, but asking for a copy of the new listing agreement is not unreasonable. They may not have received the notice to terminate the listing. In my office the agent can't cancel a listing, has to be done by broker or contract reviewer.

Frankly if I had no advance notice and got a call from another agent, that they were now listing the property I would be asking for documents too.

So I would send copy of listing agreement, and ask the AM for a copy of the termination of the other listing, This would put the AM on notice that I could not meet the 24 listing requirement due to circumstances outside my control.

he knows fremont was sold .. i taked to him 4 weeks ago when i got my referral.. he should contact the old assit..the seller that he had a contract with is no longer the seller. i just spent over 300 on weeds that where higher the windows on the side of the house. so i thinks he knows.. what he wants is the name of the new assit com. i may send a copy with the assit company whited out.

Don't bother the the other agent any more! I agree with Alabama, you can not meet your 24 hour listing requirement until they complete the termination with the other agent.

His listing was completely terminated over a month ago when a new seller took over the property. he has no one to present offer to.

KGM - don't be so sure that the other agents agreement was offically terminated over a month ago.

I have a Fremont listing, took over by that other bank. Because I have an offer on it, they are quite confused about who has the listing - they've taken it off resnet but have not sent me a termination nor an EMD release. The new bank does not use resnet as their servicer so it's a mess.

Although he doesn't need to know your servicer, he has a right to question that he is actually losing the listing. Just send him your listing agreement and be done with it.
