I signed a contract on a house being built in Jan of 04' the first close date was 4/30/04, then 5/16/04 now its 5/28/04 becuase rates have gone up I am already 1500 down to extend and the mortagage company will not extend again. The house might be finished but I spoke to the realtor and they said they have tried everything and becuase there is back up offer he doesnt care what is my course of action?

First things first.. Sorry that you are having such a problem with your deal... Please understand that we are only giving you opinions and not necessarily a legal opinion...

Now I would speak to the agent involved... Not on the phone, pin him/her down and find out what exactly the problem is with this... If you get the same reaction or type of reaction, then you need to sit down with the agent's broker... Now if I understand this correctly, you are purchasing a house that is being built.. Right... Another thing to do is to talk direct to the builder and find out exactly why he/she is having such problems... It sounds as if the builder and/or agent is being put in a pinch for something and they don't want to admit it...

Oh by the way... The agent should not have the "I don't care!" attitude... My apologies from the rest of us real estate professionals if that is the tone that the agent is taking with you... Many of us strive very hard to keep our public image up as Real Estate PROFESSIONALS and every consumer that gets a bad taste just hurts our industry's name...

There is a back up offer? Is it for more than yours?

I would hope that there is a legit. reason for the delays, but that might not be the case...especially when they told you that they don't care because they have a back up.
