That is my question.

Have you formed an LLC (or an S-corp)?

Are you still unincorporated?

Are you planning to incorporate at some future time based upon some benchmark?

I am trying to decide. Right now, it appears that the basic advantage is asset protection (in case of some car accident or other event while showing customers/clients around).

Any insight?

are you talking about incorporating as an agent for commissions or for purchasing assets?
My brokerage is an S-Corp. My investment properties are all in my LLC.

I have been operating for a little over 2 years as a sole proprietor but have also considered if I should be changing my business to an LLC. I will be interested in whatever response this post draws.

Talk to a TAX LAWYER or good CPA!! Don't take legal advice off any Forum. My Lawyer laid it all out on the table and we went with a LLC. But we do own the Brokerage. If you have an attorney who closes a lot of deals for you, they will most likely take care of the process for you for free. Good Luck. BigC

If you aren't incorporated you are leaving serious money and protection on the table. Nothing is 100 percent but it goes along way as long as procedures are follwed and you don't " pierce the corporate veil"

Example in an llc you can cut the self-employment tax in half by claiming dividends which reduces your taxes owed. It's really how you are structured and everything has advantages and disadvantages. I would talk to a r.e. tax attorney who understands the tax law for brokerages and agents so you can get the maximum deductions.

A general tax practitioner is not going to know as much as a tax specialist for that field.

I am an LLC, I did that without the advice of my accountant, but at a certain point and income I will probably change to a S-Corp.

Definantly consult an good accountant and/or a tax attorney.

Thanks for the responses.

I wasn't looking for legal advice, just some insight into what decisions/events, etc. drove some of you to incorporate or to remain unincorporated.
