I have 2 past scheduled closing dates ( title issues) , title companies are not doing their jobs ( ocwens ) ...both listing agreements are on their last days .... and Both Assets got switched to new asset managers today ... I can't get an extention for closing , and extention for listing aggrement ...I can get some tylenol

I know EXACTLY what your talking about! Had two Ocwen closings last month and BOTH were a NIGHTMARE! Some issues with the title companies. I'm a pain and call the title company every day for two weeks prior to the closing date to make sure we are still on track, so I was able to nip some of the issues in the bud, but for one of them, two days before closing, the title company informed me that there was no foreclosure deed on file and they could not record the deeds simultaneously. It was THREE MONTHS after the auction date. You'd think someone would've noticed, but no, of course not. I wonder.....are you having as much fun with invoices as I am? REJECT, REJECT, REJECT. This is madness! I just had another one of these gems go under contract yesterday, so I can look forward to all of the problems I'll have up until the closing! I haven't gotten a new Ocwen listing in over a month and frankly, I'm not to upset about it!

I have a similar title issue going on now, but from what I was told it was cleared and will close next week. As far as invoices, one was rejected because the plumber put my business address on it but not the property address. Then I added the property address and it was rejected again. Finally, I removed my business address and it went through. I guess it was my fault for not noticing the missing property address though.

Is anyone having title issues involving New Century?

Right before Xmas I was to close a deal by December 15, 2007. On the day of funding, escrow/title tells me they can't fund/close because my client, the bank did not have the right to sell. You know how the buyer's agent and buyer reacted; but I had a good working relationship with buyer's agent.

It seems, my client purchased the property while New Century had filed bankruptcy, during that 60-90 day period that New Century had permission from the court to sell off assets. However, the "paperwork" was not in order and county documents had not been properly filed establishing my client's right to sell.

Initially, we were told that it could take up to 90 days to resolve the issue. I did my best to keep my buyer's agent interested, but we lucked out and received authorization to proceed and closed on 12/31/07.

Now for every escrow I open up, I specifically ask escrow/title to search the prelim title report to determine if New Century was a recent mortgagee to clearly determine that my client has the right to sell the property.

I had a closing scheduled with them last Friday and not a peep!
I couldn't beleive it on my buyers bank side and ocwen side and then Monday POOF lets cloase and lets close now!
Then gets schedules for this Monday!
Never ran into this before..... Nothing surprises me thoe!

I notice they used to not record the FC deed until after the property was in escrow, then they did it concurrently. But now I'm seeing the banks name is on the tax records much sooner after the FC sale than it used to be.
