When doing both a RE transaction and also handling the loan for a client, is the necessary form in Winform? Disclosure for both buyer and seller. Thanks in advance.

I have never seen one in WinForms. I just browsed through all of the disclosures in WinForms and did not see anything relating to that.

If you work for an office, they should have one. If you are a broker working for yourself, write one up. If your only goal is to disclose to all parties that you are an agent in the transaction and the one providing the loan to the buyer, you can use other disclosures as a model to create your own. I often find different types of things I want to disclose or get something in written form and I will create my own using other disclosures as a guide.

Of course, THIS IS NOT LEGAL ADVICE. The official advice should probably be to talk with whatever real estate attorney you use. If you work for an office, they should have one. If you work for yourself and you don't have a relationship with a real estate attorney, you have much bigger problems! ;-)

I work for myself, I figured there are alot of realtors/brokers doing both. I do work for myself and not an office and just starting to do both. The DRE states it must disclose to both buyer and seller: the form, amount and source of compensation for the loan. I just figured I would ask in here in case someone did have one or if DRE or another source had it. Yes an attorney, CPA, Contractor, etc..... are all part of a good mastermind team. God bless.

Winforms doesn't have such a form. If you're a broker call CAR legal for a second opinion on the advice given by your real estate counsel.

winforms is set by the California Association of realtors. Realtors are not loan officers. therefore, winforms will not have this disclosure
